Terms of Service

1. What Aviano Is

Aviano is a social flight tracking service. It lets you log flights you have taken or plan to take, follow the flights of friends and family, view flight status information sourced from third-party aviation data providers, and participate in community features.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. We may suspend or terminate accounts we reasonably believe belong to ineligible users.

3. Your Account

You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us immediately at support@avianoapp.com if you suspect unauthorized use of your account. You may request account deletion at any time from the app's Settings screen. Deletion is completed after a 24-hour cancellation window, during which you may cancel the request in Settings.

4. Flight Information Disclaimer

Flight data displayed in the Service is provided for informational and entertainment purposes only. It is sourced from third-party providers and may be delayed, incomplete, or inaccurate.

• Do not rely on the Service for travel decisions with financial or legal consequences (e.g., when to leave for the airport, whether a flight is cancelled, connection viability). Always confirm with your airline or airport.
• The Service is not a source of operational, navigational, or safety-of-life information and must never be used for aircraft operation, air traffic purposes, or emergency response.
• We do not guarantee the availability, accuracy, or timeliness of any flight data.

5. Your Content

The Service lets you submit content such as flight logs, profile information, photos, and comments ("User Content"). You retain ownership of your User Content. By submitting it, you grant Aviano a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your User Content solely as needed to operate, improve, and promote the Service, consistent with the visibility settings you choose (Private, Family, Friends, or Public).

You represent that you have the rights to the content you submit and that it does not violate any law or third-party right. Deleting content or your account ends this license, except for (a) content already shared with other users under your chosen visibility settings, to the extent it persists in their views or backups for a limited period, and (b) copies retained as required by law.

6. Community Rules

You agree not to:

• Harass, threaten, impersonate, or defame others, or post hateful or discriminatory content;
• Post content that is unlawful, obscene, or infringes intellectual property or privacy rights;
• Use the Service to track or monitor any person without their knowledge and consent, or otherwise stalk or surveil others;
• Scrape, harvest, or bulk-download data from the Service, or access it by automated means other than official interfaces;
• Reverse engineer, interfere with, or disrupt the Service, probe its security, or circumvent access controls or subscription gating;
• Resell or commercially exploit the Service or its data without our written permission;
• Upload malicious code or use the Service to send spam.

We may remove content or suspend or terminate accounts that violate these rules.

7. Subscriptions (Aviano Business and First)

Parts of the Service require a paid subscription (Aviano Business or Aviano First), offered in the plans and prices shown in the app at the time of purchase.

• Billing. Subscriptions purchased on iOS are billed by Apple through your Apple ID account. Apple is the merchant of record for those purchases; its terms also apply.
• Auto-renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Cancellation. Manage or cancel your subscription in your device's App Store subscription settings. Deleting the app or your Aviano account does not by itself cancel an App Store subscription.
• Refunds. Refunds for purchases made through Apple are handled by Apple under Apple's policies. Nothing in this section limits any non-waivable refund or withdrawal rights you have under applicable consumer law, including the Brazilian Consumer Defense Code (CDC).
• Changes. We may change subscription features or pricing prospectively; price changes will not apply to a current paid period and will be notified as required by the applicable app store and law.

8. Intellectual Property

The Service, including its software, design, branding, and content we create, is owned by Aviano or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on your personal devices for your personal, non-commercial use. Aviation data is licensed from third-party providers and may not be extracted or redistributed.

9. Third-Party Services

The Service depends on third parties, including flight data providers, Apple (payments), RevenueCat (subscription management), Supabase (infrastructure), and PostHog (analytics). We are not responsible for third-party services, and links to third-party content do not imply endorsement. See our Privacy Policy for how these providers process data.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service, in each case with notice where reasonably possible and required by law. Sections that by their nature should survive (including 4, 5, 8, 11, 12, and 13) survive termination.

11. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-interruption. This does not exclude warranties or rights that cannot be excluded under applicable law, including mandatory consumer protections under the CDC for users in Brazil.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Aviano will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service — including reliance on flight information (see Section 4). Where liability cannot be excluded, our total liability is limited to the greater of (a) the amounts you paid to us for the Service in the 12 months before the event giving rise to the claim, or (b) the minimum amount permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law, including under the CDC.

13. Governing Law and Disputes

These Terms are governed by the laws of the Federative Republic of Brazil. Disputes will be submitted to the courts of the consumer's domicile for consumer disputes, otherwise São Paulo, Brazil. If you are a consumer, you retain the right to bring claims in the courts of your own domicile as guaranteed by the CDC.

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you in the app or by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance. The current version is always available at this page.

15. General

If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, with notice to you. These Terms, together with the Privacy Policy, are the entire agreement between you and Aviano regarding the Service.
